HKHA</span><span style="color:rgb(64, 64, 64)">. This decision is the latest in a series of landmark judgments advancing LGBTQ+ rights in Hong Kong, including recognition of foreign same-sex marriages for taxation, civil service benefits, and dependent visas. These rulings underscore the court&rsquo;s commitment to equality under Article 25 of the Basic Law (BL) and Article 22 of the Bill of Rights Ordinance (BORO).</span></span><br /><span><span style="color:rgb(64, 64, 64)">However, the court also emphasized balancing societal interests with individual rights. To achieve this, it applied the four-step proportionality test from </span><span style="color:rgb(64, 64, 64)">Hysan Development Ltd v. Town Planning Board</span><span style="color:rgb(64, 64, 64)">, a flexible framework for scrutinizing restrictions on constitutional rights.</span></span><br /><br /><br /><u><span><span style="color:rgb(0, 0, 0); font-weight:700">Hysan</span><span style="color:rgb(0, 0, 0); font-weight:700"> test, a flexible framework<br /></span></span></u><br /><span><span style="color:rgb(0, 0, 0)">Restrictions on constitutional rights are all subject to scrutiny. The well-established four-stage </span><span style="color:rgb(0, 0, 0)">Hysan</span><span style="color:rgb(0, 0, 0)"> proportionality test is routinely applied as a crucial part of the judicial review process. The four-stage </span><span style="color:rgb(0, 0, 0)">Hysan</span><span style="color:rgb(0, 0, 0)"> test is a cornerstone of Hong Kong&rsquo;s judicial review process:</span></span><br /><br /><span><span style="color:rgb(0, 0, 0)"><u>Legitimate Aim:</u> Does the policy pursue a valid goal?</span></span><br /><span><span style="color:rgb(0, 0, 0)"><u>Rational Connection</u>: Is the policy rationally linked to that goal?</span></span><br /><span><span style="color:rgb(0, 0, 0)"><u>Minimal Impairment</u>: Is the policy no more restrictive than necessary?</span></span><br /><span><span style="color:rgb(0, 0, 0)"><u>Balancing Exercise:</u> Does the policy strike a reasonable balance between rights and societal benefits?<br />&#8203;</span></span><br /><span><span style="color:rgb(0, 0, 0)">For LGBTQ+ cases, the court applies a stricter standard at stage three (no more than reasonably necessary), especially when fundamental rights are at stake.</span></span><br /><br /><br /><u><span><span style="color:rgb(0, 0, 0); font-weight:700">Legitimate Aim and Rational Connection</span></span></u><br /><u><span><span style="color:rgb(0, 0, 0)"><br />Step 1: Legitimate Aim?</span></span></u><br /><span><span style="color:rgb(0, 0, 0)">The government argued that subsidized housing policies aimed to encourage procreation within traditional (opposite-sex) families. The court accepted this as a legitimate aim, citing precedents like </span><span style="color:rgb(0, 0, 0)">Sham Tsz Kit v. Secretary for Justice</span><span style="color:rgb(0, 0, 0)"> (2023).<br /></span></span><br /><u><span><span style="color:rgb(0, 0, 0)">Step 2: Rational Connection?</span></span></u><br /><span><span style="color:rgb(0, 0, 0)">Here, the government&rsquo;s argument faltered. The court found no evidence that excluding same-sex couples materially encouraged opposite-sex families to have children. Critically, the number of affected same-sex couples was de minimis (too few to be considered significant, and hence cannot materially impact opposite-sex families). Without empirical data, the Housing Authority (HA) failed to justify the exclusion.&nbsp;</span></span><br /><br /><br /><u><span><span style="color:rgb(0, 0, 0); font-weight:700">Minimal Impairment: Key Scrutiny<br /></span></span></u><br /><span><span style="color:rgb(0, 0, 0)">The Court of Final Appeal acknowledged and respected the government&rsquo;s authority in making policy, and is equally aware of how it could impact and disadvantage certain groups of people, especially in socially redistributive decisions. In fulfilling their role of checking the government&rsquo;s power, the courts require the executive&rsquo;s policies to achieve their aims with methods that are no more than necessary.<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">Particularly, the apex court placed emphasis on the lack of empirical evidence to support the HA&rsquo;s claims. It noted that whether evidence should be required to back up a justification depends on case facts, context, and the nature of the justification itself. The courts acknowledged that reasoning based on moral or political considerations may lack evidentiary support, and thus be more readily accepted even without proof. However, the same cannot be said for socio-economic justifications, where the courts require substantial evidence.&nbsp;<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">Despite being in the best position to obtain information on how many opposite-sex couples benefit from the total exclusion of same-sex couples in this policy, the HA did not provide such data. This failure doomed the policy at stage three of the proportionality test.&nbsp;</span></span><br /><span><span style="color:rgb(0, 0, 0)">Indeed, not only was the HA&rsquo;s case criticized for the complete lack of evidence to support their arguments, but it was also undermined by the absence of less restrictive measures that would also support their aim. For example, the apex court suggested prioritizing opposite-sex couples in housing queues while still letting same-sex couples apply.&nbsp;</span></span><br /><br /><br /><span><span style="color:rgb(0, 0, 0); font-weight:700"><u>Balancing Exercise: Equality vs. Competing Interests</u><br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">At the last stage, the HA&rsquo;s argument that relaxing these policies would significantly thwart the promotion of traditional family structures, again, fails for lack of empirical data. Although the supply of housing is highly limited, the impact of including same-sex couples in &ldquo;ordinary family&rdquo; would be shared among the different types of family structure, so relaxing these policies does not undermine opposite-sex couples&rsquo; rights under Basic Law Art. 36. These policies are mainly concerned with applicants who are in the low- to middle-income strata; restricting same-sex couples from applying for and living in public renting housing units together may affect their ability to share a family life.<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">The HA suggested that including same-sex couples would disrupt its broader housing policy framework. The court rejected this outright, noting that equality rights under the Basic Law cannot be sidelined by administrative convenience.</span></span><br /><br /><span><span style="color:rgb(0, 0, 0); font-weight:700">&#8203;<br /><u>Interaction with Landmark LGBT Precedents<br /></u></span></span><br /><span><span style="color:rgb(0, 0, 0)">Infinger Nick</span><span style="color:rgb(0, 0, 0)"> builds on two pivotal cases in the development of LGBTQ rights in Hong Kong: </span><span style="color:rgb(0, 0, 0)">QT v. Director of Immigration</span><span style="color:rgb(0, 0, 0)">, which recognized foreign same-sex marriages for dependent visas; and </span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong v. Secretary for the Civil Service</span><span style="color:rgb(0, 0, 0)">, which extended spousal benefits to same-sex couples. Both cases involved couples in foreign civil partnerships.<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">Notably, </span><span style="color:rgb(0, 0, 0)">Infinger Nick</span><span style="color:rgb(0, 0, 0)"> relies on the interpretation of BORO and Basic Law rights from </span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)"> and </span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)">. </span><span style="color:rgb(0, 0, 0)">Infinger Nick</span><span style="color:rgb(0, 0, 0)"> refers to BORO Art. 1 (</span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)">) and BORO Art. 22 (</span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)">), and Basic Law Art. 25 (</span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong &amp; QT</span><span style="color:rgb(0, 0, 0)">), as well as Basic Law Art. 39 (</span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)">) to support the idea of equality. The Court in Infinger Nick concluded that &ldquo;there is no warrant to read a Basic Law guarantee on pre-existing social welfare rights as trumping the constitutional requirement of equality before the law under BL and of [BORO]&rdquo;.<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">Two lines of reasoning from </span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)"> and </span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)"> permeate through the decision of the present case. Firstly, unlawful discrimination is &ldquo;fundamentally unacceptable&rdquo; (</span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)"> at [27]-[28]). Secondly, &ldquo;same-sex couples who are lawfully married overseas are in an analogous and comparable position to opposite-sex married couples&rdquo; considering the &ldquo;publicity and exclusivity&rdquo; of the relationship (</span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)">).&nbsp;<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">There are also some key differences. </span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)"> and </span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)"> both found it unnecessary to proceed with the last test of reasonable balance since &ldquo;sexual orientation of spouse is not rationally connected to talent aim&rdquo; in </span><span style="color:rgb(0, 0, 0)">QT</span><span style="color:rgb(0, 0, 0)"> and &ldquo;financial benefits on spouses taxation were not conferred to protect the institution of marriage&rdquo; in </span><span style="color:rgb(0, 0, 0)">Leung Chun Kwong</span><span style="color:rgb(0, 0, 0)">.&nbsp;<br /></span></span><br /><span><span style="color:rgb(0, 0, 0)">The present case, however, reaches the third and fourth steps of the test since there may be a connection between promoting traditional family structures and favouring opposite-sex couples in the application for HA units. Some couples, be they homosexual or heterosexual, might enter into committed loving and stable, long-term relationships in which they wish to make their lives together for the rest of their lives. The law has provided heterosexual couples a right of getting married, an institution carrying with a bundle of rights and responsibilities conferred to the couple. Of course, they can, as they see fit, choose to stay together and found a family without getting married. However, as the courts have stressed many times in different judgments, that under Hong Kong law, homosexual couples do not have access to marriage for the legal rule of </span><span style="color:rgb(0, 0, 0)">lex specialis&nbsp;</span><span style="color:rgb(0, 0, 0)">(see below for further). It was held, by a majority of 3 to 2, that the government has a positive obligation under Article 14 of the Hong Kong Bill of Rights to establish an alternative framework for legal recognition of same-sex partnerships, and the government violated it. Notwithstanding the fact that homosexual couples cannot get married in Hong Kong, they now (at least in 2 years of time) have access to an alternative framework for legal recognition for their relationship. This battle for same-sex partners to have the same marital rights as heterosexual couples has deep historical roots, tracing back to 1991 when specific same-sex acts were decriminalized with the introduction of the Hong Kong Bill of Rights Ordinance. It was only after many years did the concept of same-sex marriage surfaced to be a matter of importance in the legal landscape, with one of the key developments signified by the case of Leung TC William Roy v Secretary for Justice [2005] 3 HKCU 1158. In this case, Leung challenged the differential treatment of the age of consent law in Hong Kong, which prohibited sexual activity between men under the age of 21, whilst the age of consent for heterosexual and lesbian couples was 16 or above. Quickly followed was the landmark case of QT v Secretary of Justice [2018] HKCFA 28, in which the Court of Final Appeal ruled in favour of granting a dependent visa to QT, whose same-sex civil partner in Britain had moved to Hong Kong. Despite acknowledging that same-sex couples also deserve equal rights to dependent visas, taxes and housing rights, courts have been reluctant to expand the reading of &ldquo;marriage&rdquo; within Article 37 of the Basic Law to include same-sex couples. Article 37 elicits the freedom of marriage of Hong Kong residents, and numerous cases such as MK v HKSAR [2019] HKCFI 2518 and the lower courts Sham Tsz Kit v Secretary of Justice had attempted to raise the unconstitutionality of excluding same-sex marriage in the definition of &ldquo;marriage&rdquo; as included in Article 37. In both cases, the court held that same-sex marriage had not been contemplated when drafting the Basic Law, and there lies a need to protect the sanctity of the traditional marriage framework between a man and a woman. Sham argued differently in proposing that the absence of alternative means of legal recognition of same-sex relationships in Hong Kong amounts to a violation of the constitutional right to privacy as enshrined in the Hong Kong Bill of Rights (cf the argument provided by the appellant for the Court in MK v Government of HKSAR [2019] HKCFI 2518) . The Court of Final Appeal ruled in favour of Sham by a 3-2 decision and has since imposed a 2-year deadline for the government to establish a new alternative legal framework to legally recognize same-sex partnerships.The ruling was hailed as &ldquo;a giant leap forward for LGBT rights'' by some, praising the Court for taking such a liberal step. In <em>W v Registrar of Marriages&nbsp;</em><font color="#24678d">[1]</font>, The majority in CFA held that the Basic Law should be seen as a &ldquo;living instrument&rdquo; so as to invest fundamental rights with an updated meaning if the social attitudes towards marriage have changed. However, the dissenting judgement argues that a firm line should be drawn between giving an updated meaning to a constitutional provision and making new policy <font color="#24678d">[2]</font>. It if is about the making of new policy, then the Legislature, instead of the Judicature, is more constitutionally and institutionally equipped, and much margin of appreciation is to be granted. To put it plainly - the latter one is not the business of the Court. In order to trigger the former function, there should be sufficient evidence that shows it is necessary for the court to interpret BL 37 differently compared to the time when it was drafted. However, there is no sufficient evidence to prove that the social attitude towards same-sex marriage has changed to such an extent that they accept that kind of marriage <font color="#24678d">[3]</font>. However, it is arguable whether a right to marry constitutes to fundamental right, or so-called &lsquo;absolute right&rsquo;. The absolute right does not need to be invoked by proving there is a breach to other rights since it will be invoked automatically. Some argues that the right to marry might not be characterized as an absolute right, as government is given the power to regulate the institution of marriage and may limit the rights for the sake of pursing legitimate public policy goal <font color="#24678d">[4]</font>. In Sham Tsz Kit, the court held that the constitutional freedom of marriage that guaranteed under Basic law only applies to opposite-sex marriage. This indicates the scope of the right to marry in Hong Kong only confines to opposite-sex marriage on the grounds of the Lex specialis principle, which means that a law governing a specific subject matter (lex specialis) overrides a law governing only general matters (lex generalis). The Hong Kong courts have also used the ICCPR to interpret the scope of Basic Law rights from time to time. On this basis, BL 37 and BORO 19(2) only create rights for opposite-sex couples, because of the explicit reference to gender in Article 19 <font color="#24678d">[5]</font>. Therefore, BL 37 should be read narrowly and it should be also read with BORO 19(2). This also means that it is not permissible to interpret the equality rights under BL25 and BORO22 as conferring a constitutional right to same-sex marriage or to recognition of foreign same-sex marriage. Hence, the specific provisions relating to opposite-sex marriage exclude the constitutional right to same-sex marriage. This is more likely to be a direct application of the existing legal principles without any justification of why same-sex marriage itself should be excluded from the protection regarding the specific provisions. It seems the strongest reason provided by the Court is that the extent of marriage does not cover same-sex marriage. For instance, one of the justifications is that same-sex marriage does not serve the social purpose regarding to procreation and children rearing. However, even opposite-sex marriage couples do not consider procreation as the purpose of getting together nowadays.
